INFORMATIVE ON THE PROCESSING OF PERSONAL DATA (ART. 13-14 REG. EU 2016/679)

    The company Dessert Manifattura Ltd. for the purposes set forth in EU Regulation no. 2016/679 on the protection of individuals with regard to the processing of personal data, hereby informs that the processing of personal data provided to the same and acquired, will be subject to processing in compliance with the legislation provided by the aforementioned Regulation in respect of the rights and obligations arising therefrom.

    A) Data controller

    B) Legal basis for processing

    The Owner processes Personal Data related to the User if one of the following conditions exists:

    • The User has given consent for one or more specific purposes;
    • processing is necessary for the performance of a contract with the User and/or the execution of pre-contractual measures;
    • processing is necessary to fulfill a legal obligation to which the Controller is subject;
    • the processing is necessary for the performance of a task of public interest or the exercise of public authority vested in the Controller;
    • processing is necessary for the pursuit of the legitimate interest of the Owner or third parties.

    However, it is always possible to ask the Data Controller to clarify the concrete legal basis of each processing and in particular to specify whether the processing is based on law, required by a contract or necessary to conclude a contract, or whether it is based on consent.

    C) Purpose of processing

    The personal data processed (by way of example: addresses, telephone and e-mail contact details, photographs, etc.) are necessary for the following purposes related to the implementation of fulfillments related to legal and contractual and pre-contractual obligations, as well as activities for the promotion of products and services similar to those requested on the basis of the consent of the person concerned; more precisely:

    • Legally required tax and accounting compliance;
    • after-sales service;
    • Marketing activities pertaining to services similar to those already purchased and business promotion;
    • Litigation management;
    • customer management;
    • customer billing history.

    The processing of functional data for the fulfillment of these obligations is necessary for the proper management of the contractual relationship and their provision is mandatory to implement the above purposes. The Controller also makes it known that failure to provide, or incorrect provision of, any of the mandatory information may result in the inability of the Controller to ensure the appropriateness of the processing.

    D) Method of processing, communication and dissemination.

    Your personal data may be processed in the following ways:

    • Article 4 no. 2 GDPR collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion and destruction;
    • Outsourcing of processing operations to third parties;
    • Entrusting third parties with promotional operations on products and services similar to those already purchased;
    • Processing by means of electronic computers/computer and/or telematic tools;
    • Manual processing by means of paper files;
    • email contact information will be used to send you, via electronic and/or paper mail, communications regarding our products, studies, events and similar services.

    All processing is carried out in accordance with the methods set out in Articles 6, 32 of the GDPR and through the adoption of the appropriate security measures provided and in any case with organizational methods and logics strictly related to the stated purposes.

    Communication: your data will be communicated only to competent and duly appointed persons for the performance of services necessary for the proper management of the relationship, with guaranteed protection of the rights of the person concerned. Your data will be processed only by personnel expressly authorized by the Controller and, in particular, by the following categories of employees: Marketing department; Administration and accounting department; Commercial department; Information activities related to the Controller’s products necessary for their promotion.

    Your data may be disclosed to third parties duly appointed as Data Processors whose list is available at the company, specifically to:

    • Group companies for administrative accounting relationship management;
    • business partners for promotional operations on products and services similar to those already purchased;
    • consultants (including IT consultants) and freelancers, including in associated form;
    • banks and credit institutions;
    • within public and/or private entities for which the communication of data is mandatory or necessary in fulfillment of legal obligations or is otherwise functional to the administration of the relationship;
    • Shippers, Carriers, Freight Forwarders, Post Offices, Logistics Companies.

    Any photographic material collected at events, events, fairs, parties may be published in social networks.

    Dissemination: Your personal information will not be disseminated in any way.

    Data are not disclosed outside the EU.

    E) Data retention period

    The storage of personal data will be for a period of time established for a period of time not exceeding the achievement of the purposes for which they are collected and processed for the execution and fulfillment of contractual and pre-contractual purposes as well as in compliance with the mandatory timeframes prescribed by law (and thus for a period not exceeding 10 years from the conclusion of the assignment-contractual relationship).

    When processing is based on the User’s consent, the Data Controller may keep the Personal Data longer until that consent is revoked. In addition, the Data Controller may be required to retain Personal Data for a longer period in compliance with a legal obligation or by order of an authority.

    At the end of the retention period, the Personal Data will be deleted. Therefore, upon the expiration of this period, the right of access, deletion, rectification and the right to Data portability can no longer be exercised.

    F) Rights of the data subject

    In relation to the data subject to the processing referred to in this notice the data subject is at all times entitled to:

    • Access (Art. 15 EU Regulation)
    • Corrigendum (Art. 16 EU Regulation)
    • Deletion (so-called right to be forgotten – Art. 17 EU Regulation)
    • Limitation (Art. 18 EU Regulation)
    • Portability, understood as the right to obtain from the data controller the data in a commonly used, machine-readable structured format for transmission to another data controller without hindrance (Art. 20 EU Regulation);
    • Objection to processing (Art. 21 EU Regulation)
    • Withdrawal of consent to processing, without prejudice to the lawfulness of processing based on consent obtained prior to withdrawal (Art. 7(3) EU Regulation)
    • Propose complaints to the Data Protection Authority (Art. 51 EU Regulation)

    The exercise of the aforementioned rights may be exercised by written notice to be sent to Dessert Manifattura srl.
